UPDATE ON DECREE NO. 283/2026/ND-CP: ADMINISTRATIVE PENALTIES FOR VIOLATIONS IN THE FIELDS OF LABOUR AND OCCUPATIONAL SAFETY AND HEALTH

Key Highlights

Decree No. 283/2026/ND-CP, issued by the Government on July 15, 2026, specifies administrative violations, forms of penalties, penalty amounts, remedial measures, and the authority to impose penalties in the areas covered by the Decree.

Key areas that businesses should pay attention to include:

  • Occupational Safety and Health Requirements: Review measures for preventing occupational accidents and diseases, employers’ responsibilities, the use of machinery and equipment subject to strict occupational safety requirements, and occupational safety and health training activities.

  • Administrative Penalties: Update the applicable violations, penalty amounts, additional penalties, and remedial measures specified in each relevant provision.

  • Limitation Periods for Administrative Penalties: The Decree stipulates a one-year limitation period for administrative violations in the fields of labour and social insurance, and a two-year limitation period for violations concerning Vietnamese workers working abroad under contracts.

  • Effective Date and Transitional Provisions: Decree No. 12/2022/ND-CP ceased to be effective when Decree No. 283/2026/ND-CP took effect. The handling of violations committed before that date should be reviewed in accordance with the transitional provisions under Article 67.

What Should Businesses Do?

To proactively ensure compliance with the new regulations, businesses should review their labour-related legal documentation, occupational safety and health training programmes, equipment inspection records, hazard identification and risk assessment activities, and occupational accident response procedures.

Such reviews should be based on the specific violations, provisions, and penalty amounts set out in the Decree, rather than relying solely on summary tables or general information published for communication purposes.
